AGREEMENT TO OUR LEGAL TERMS

We are Art Monthly Australasia, trading as Blue Art Journal ABN 90 008 651 385, doing business as Blue Art Journal (“Company”, “we”, “us”, or “our”), a company registered in Australia at:

We operate the website http://www.blueartjournal.com (the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”). A journal publishing writing on global First Nations art. You can contact us by email at editorial@blueartjournal.com or by mail at the address above.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Art Monthly Australasia, trading as Blue Art Journal ABN 90 008 651 385, concerning your access to and use of the Services.

By accessing the Services, you have read, understood, and agree to be bound by these Legal Terms. If you do not agree, you must discontinue use immediately.
We may update these Legal Terms at any time. We will update the “Last updated” date accordingly. It is your responsibility to review these terms periodically. Continued use of the Services means you accept any changes.

The Services are intended for users who are at least 18 years old.

We recommend that you print a copy of these Legal Terms for your records.

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation.
Users accessing the Services from other locations do so at their own initiative and are responsible for compliance with local laws.

2. INTELLECTUAL PROPERTY RIGHTS

Our Intellectual Property
We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics (collectively, the “Content”), as well as trademarks, service marks, and logos (the “Marks”).
The Content and Marks are protected by copyright and trademark laws.

Your Use of Our Services

Subject to compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to:

  • Access the Services; and
  • Download or print portions of Content you have properly accessed solely for personal, non-commercial use or internal business purposes.

No Content or Marks may be copied, reproduced, republished, distributed, sold, or otherwise exploited without our prior written permission.

3. USER REPRESENTATIONS

By using the Services, you represent that:

  • You have legal capacity and agree to comply with these Legal Terms.
  • You are not a minor in your jurisdiction.

  • Your use will not violate any applicable law.
  • If you provide false or incomplete information, we may suspend or terminate your access.

4. SUBSCRIPTIONS

Billing and Renewal

We will contact you by email before your subscription expires.

Cancellation

You may cancel at any time by logging into your account. Cancellation takes effect at the end of your current paid term.

Fee Changes

We may change subscription fees from time to time and will communicate changes in accordance with applicable law.

5. PROHIBITED ACTIVITIES

You may not use the Services for any purpose other than their intended use. You agree not to:

  • Retrieve data to create a database without permission
  • Defraud or mislead users
  • Circumvent security features
  • Harass or harm others
  • Use the Services unlawfully
  • Engage in unauthorised framing or linking
  • Upload viruses or malicious code
  • Use bots, scrapers, or automated tools
  • Impersonate another user
  • Reverse engineer the software
  • Collect user data for unsolicited emails
  • Use the Services to compete with us
  • Breach cultural protocols as defined by Blue Art Journal
  • Override ICIP principles
  • Appropriate Indigenous cultures using AI
  • Violations may result in termination.

6. USER GENERATED CONTRIBUTIONS

If you submit content (“Contributions”), you represent that:

  • You own or have rights to the content
  • It does not infringe third-party rights
  • It is not misleading, unlawful, or harmful
  • It does not violate privacy rights
  • It does not contain discriminatory or offensive material
  • You are solely responsible for your Contributions.

7. CONTRIBUTION LICENCE

By submitting feedback or suggestions, you allow us to use and share that feedback without compensation.
You retain ownership of your Contributions. We are not responsible for your statements.

8. ADVERTISERS

We allow advertisers to display advertisements within the Services. We provide space only and have no other relationship with advertisers.

9. SERVICES MANAGEMENT

We reserve the right to:

  • Monitor for violations
  • Take legal action
  • Restrict or remove content
  • Manage the Services to protect our rights

10. PRIVACY POLICY

By using the Services, you agree to our Privacy Policy.
The Services are hosted in Australia. If you access from another jurisdiction, you consent to the transfer of your data to Australia.

11. TERM AND TERMINATION

These Legal Terms remain in effect while you use the Services.
We may suspend or terminate access at our sole discretion without notice.

12. MODIFICATIONS AND INTERRUPTIONS

We may modify or discontinue the Services at any time without notice.
We are not liable for downtime or interruptions.

13. GOVERNING LAW

These Legal Terms are governed by the laws of Australia.
The courts of Australia have exclusive jurisdiction.

14. DISPUTE RESOLUTION

  • Informal Negotiations: Parties agree to attempt informal resolution for thirty (30) days before arbitration.
  • Binding Arbitration: Disputes will be resolved by arbitration seated in Canberra, Australia.
    • Language: English
    • Governing law: Australia
  • Restrictions: No class actions or representative proceedings.

15. CORRECTIONS

We reserve the right to correct errors or inaccuracies at any time without notice.

16. DISCLAIMER

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
YOU USE THE SERVICES AT YOUR OWN RISK.
WE DISCLAIM ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
